These Terms of Service ("Terms") govern your use of the CalorieToday app and website (together, the "Service"), operated by CalorieToday ("we", "us", "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Description of the service

CalorieToday is a calorie, macro, water and weight tracking application. It provides food logging tools, a searchable food database, progress charts, and related features to help you track nutrition and fitness-related information. The Service is provided on an "as is" and "as available" basis.

2. Free and Pro subscription terms

CalorieToday offers a free tier and a paid "Pro" subscription tier. The free tier includes core tracking features, supported in part by advertising. The Pro subscription is billed either monthly or annually via Stripe, our third-party payment processor, at the prices displayed on our Pricing page at the time of purchase.

  • Subscriptions automatically renew at the end of each billing period unless cancelled beforehand.
  • You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of your current billing period.
  • We do not provide refunds for partial billing periods, including if you cancel partway through a month or year, except where required by applicable law.
  • We may change subscription pricing going forward; any price changes will not affect a billing period you've already paid for, and we'll provide reasonable notice before a price change applies to your next renewal.

3. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to: misuse or attempt to disrupt the Service (including through unauthorized access, scraping, or interference with its normal operation); use the Service to violate any applicable law or the rights of others; or reverse engineer, resell, or redistribute the Service except as expressly permitted.

4. Not medical advice

Calorie, macro, BMR, TDEE, BMI, and any other nutrition or fitness-related calculations provided by the Service are estimates for general informational purposes only. They are not medical advice, and they are not a substitute for professional medical, nutritional, or health guidance. Always consult a qualified healthcare professional before making decisions about your diet, exercise routine, or health, particularly if you have a pre-existing medical condition.

5. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any calculations or data will be perfectly accurate.

6. Limitation of liability

To the fullest extent permitted by law, CalorieToday and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

7. Account termination

You may stop using the Service, or delete your account and data, at any time from the app's Profile screen. We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if required to do so by law. Where reasonably possible, we will provide notice before termination.

8. Changes to these terms

We may update these Terms from time to time to reflect changes in the Service, our practices, or applicable law. We will update the "Last updated" date above when changes are made. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by the laws of the United States, without regard to its conflict of law principles, except where applicable local consumer protection law provides otherwise.
